The stakes were high: my client was charged with possession of a controlled substance, MDMA, 4-200g, with intent to deliver or sell, a 1st degree felony, punishable by 5-99 yrs in prison. To complic ... ate matters, my client also does not have a legal citizenship status, and faced deportation if he was convicted, or even if he were to plead guilty and was placed on probation. Client was searched by private security at the entry of "Something Wicked" 2016, and the controlled substances were found in his groin area. Despite the search being done by private security, it was discovered that the arresting officer and 31 other Sherriff's deputies were working the event. The scheme seemed apparent: have the private security that are not off-duty law enforcement do the illegal search, then bring the off-duty law enforcement working security the fruit of that illegal search. This way, I suppose they felt immune to complaints about how the search was conducted. We set it for trial and fought the search. Luckily, the ADA working this case did his trial prep and determined suppression of the evidence was very possible - and dismissed the case.
