Client was charged with 2nd Degree Eluding and 4th Degree Resisting Arrest for foot flight when car stopped. Client was in legal possession of car. There was no issue of any contraband in car or on c ... lient. Police, in an unmarked car, and in plainsclothes, pursued the client who did not stop for them, Case was tried before Judge Petroole. Client did not attend his trial. Jury found client Not Guilty of the 2nd Degree Eluding, No Guilty of the 3rd Degree Eluding, which was submitted to them as a lesser included charge, and Guilty of the 4th degree flight by foot,(resisting arrest).
