I inherited this case from another lawyer who did not do his due diligence and watch all of the video surveillance, the bodyworn video and review medical records and all of the police reports. There wa ... s a plethora of discovery and I uncovered all of it. I went to trial and fought against two prosecutors with a difficult judge. The outcome was NOT GUILTY! There is no such thing as a "slam dunk" this came with working 12-14 hours a day, subpoenaing officers, interviewing witnesses, getting an expert appointed, and watching and re-watching ALL of the video, to name a few. It was a battle from the word go-but we never gave up!
OUTCOME: VICTORY
A probable cause hearing is a preliminary hearing. The threshold for the people is very low. They only need "just enough evidence" for the magistrate to hold you to answer to the Superior Court. Anytim ... e a defense attorney wins at this level, it is a huge victory. The client was held to a lessor charge but the strike was thrown out. What a relief to him and his family!

My client had no criminal history and was incarcerated for the first time for a 422 felony strike (criminal threats). On the 3d day of a pre-lim that kept getting continued he said "I'll just take the ... deal" (which was state prison!) I told him he was IN PANIC MODE and walked away. The following Monday, 2 days later, I got the case dismissed. I saved him from himself and his parents were very happy. Client went home that day-he stood up and cheered for me in a packed courtroom!!
OUTCOME: 2 Felony Counts reduced to 1 misdemeanor, no probation.
This case was originally a "hand me down". The former attorney conflicted out and I stepped in. I worked hard on the case and had the matter investigated. Turns out the "victims" were both meth addicts ... with raspsheets.. After taking the matter to trial, we resolved on Day 3. Client released that day. Probation Violation terminated.
