OUTCOME: Husband was released from ICE on April 24, 2014

Husband and Wife were arrested by ICE in March 2014. Wife was issued an Order of Supervision due to an old exclusion order. HUsband had a final order of removal which was executed a few years ago. Husb ... and reentered the US a couple of months after removal and was again caught by ICE in March 2014. Stay of removal filed and motion to reopen was also filed due to the fact that he had not abandoned his continuos presence. Argument made that due to his 3 sick children hardship was present and he had accumulated enough physical presence prior to his removal to qualify for cancellation of removal.

Labor Certification under 245i

OUTCOME: LPR status GRANTED

Ecuador citizen had filed a Labor Certification under the grandfather in of 245i in 1998, this labor certification was approved but I-140 was ultimately denied. New Labor Certification was filed in 20 ... 05 based on new occupation, 2 attorneys filed Adjustment of Status based on the new labor certification but AOS was denied due to change in occupations that position was not in similarly situated occupation. Our office filed a BRIEF MEMO on this issue as to the portability and new occupation not voiding client's eligibility for Adjustment of Status even under new occupation. Case was granted at the time of 245 interview.
