Kristin S. Mutzig, Esq., recently obtained a favorable settlement for her client in a case involving claims of negligent security of an apartment complex. The plaintiff, a college student, alleged her ... client had failed to promptly respond and provide reasonable security after notice of a break-in. This resulted in another break-in whereby the plaintiff was assaulted and sustained significant fractures to his jaw bone requiring immediate surgery and his jaw being wired-shut jaw for over 6 weeks. Surgery healed, but ongoing residual pain and complaints were alleged and contested. During litigation, Ms. Mutzig was able to detect plaintiff’s issues with liability, including but not limited to the lack of time between the break-ins as well as the relationship between his roommate and the trespassers, all of which helped successfully resolve this case for a relatively nominal sum.

Plaintiff, Katrina Hayes, claimed she sustained serious and permanent injuries in her back as a result of an accident involving a SEPTA bus and a vehicle operated by the Additional Defendant, Mohammad ... Shaikh. Hayes was a passenger on the bus. The accident occurred when Shaikh made a right hand turn in front of the SEPTA bus that had pulled away from a bus stop. Hayes alleged as a result of the impact, she was thrown violently forward and backward in her seat causing her to suffer a herniation. The crucial evidence consisted of a SEPTA video which displayed Luise sitting in her seat and only slightly move when the impact occurred. Despite this video, Luise still claimed she was severally injured. After a three day trial, the jury found no negligence on either defendant and returned a defense verdict in favor of SEPTA and Shaikh. No appeal was taken.

Plaintiff, Eileen Luise, claimed she was a passenger on a SEPTA bus when the operator slammed on the brakes causing her to be thrown out of her seat and onto the ground. As a result of the sudden braki ... ng, Luise claimed she injured her back and both her knees which resulted in bilateral knee replacement surgery just eight months later. Following the surgery, she brought suit against SEPTA for both negligence and uninsured motorist benefits. Plaintiff demanded $250,000. During trial, Mutzig effectively cross-examined Luise who ultimately admitted the SEPTA operator slammed on the brakes to avoid a collision with another vehicle who had cut in front of the bus. Mutzig argued to the jury that this incident was not the fault of the SEPTA operator, as he acted as any reasonable driver would under the circumstances and successfully avoided a collision. After a three day trial, the jury returned a verdict in favor of SEPTA. No appeal was taken.
