Former spouse alleged bad faith in this motion, and allegation which lacked merit because there was no evidence to support this. The matter required forensic review of bank records, review of applicable case law, depositions, and motion practice. In family law cases such as this, where the former spouse's case lacks merit, judgment without a trial is available by filing a motion for summary judgment. This is called "summary judgment."

A person filed a temporary stalking protective order against my client based on a few confrontations. My client never threatened the person and never acted in a threatening way. In fact, the freedom ... of speech protects language used in the absence of threats. Sometimes the language might even be derogatory, which was not the case here. Furthermore, when the alleged perpetrator has to be in the presence of the alleged victim to do their employment may not qualify for a stalking order unless it is in the context of a threat to personal safety. This person's allegations were bare of any threats, and I moved to dismiss at the close of the case and chief.
