Record-setting $7.5 million CRPS settlement
Sep 16, 2022OUTCOME: $7.5 million settlement, the largest settlement for CRPS in Illinois history
Our client was riding a motorcycle southbound on First Avenue in Maywood when a vehicle pulled out from a stop sign directly in front of him. Our client was unable to avoid the collision and suffered c ... atastrophic injuries, including a badly fractured foot, fractured toe, and complex fracture of the left hand which led to his pinky being amputated. In addition to numerous surgeries, our client also developed complex regional pain syndrome (CRPS), a complicated neuropathic pain condition that occurs in 3-4% of orthopedic fractures. He underwent innumerable therapies and injections before having a spinal cord stimulator implanted in his low back. The insurance lawyers hired an expensive accident reconstructionist to claim our client was speeding, hired a well-known pain management doctor to dispute the diagnosis of CRPS and claim our client was exaggerating his injuries, and hired a vocational rehab expert to claim our client could return to work. We immediately filed a lawsuit, litigated the case hard, and turned down a $3 million offer at mediation. Ultimately, once the case was certified for trial, the insurance lawyers realized we were serious about taking our client's case to a jury, and agreed to settle the case for $7.5 million. This was the largest CRPS settlement in Illinois history, significantly topping the previous record of $6 million.
