This appointed case arose out of the alleged violation of inmate Dennis Jackson’s constitutional right to be free from the use of excessive force. Jackson claimed that prison guards at the Illinois St ... ate maximum security prison located in Menard, Illinois used excessive force in breaking up a fight he was having with another inmate. Specifically, he alleged that the fight had already ended before the prison guards threw him to the ground, breaking his finger. He also alleged that the guards then slammed his head against a sharp object, causing him a head laceration and surgery at an outside facility.

Plaintiff alleged that Dr. Ligon breached the standard of care by waiting until 10:20 a.m. to call an anesthesiologist or an otolaryngologist to help secure Weaver’s airway. Plaintiff claimed that bec ... ause Dr. Ligon waited until 10:20 to call for assistance in securing Weaver’s airway, she was unable to secure it. This, in turn, allowed Weaver’s airway to swell shut and caused Weaver to go into cardiac arrest, slip into a coma and eventually die.

Plaintiff was the surviving daughter of Freddie Burns who allegedly suffered from pressure sores, malnutrition, and a head injury when she fell from her wheelchair while a resident at Leland Health Car ... e nursing home. Plaintiff claimed that these conditions rendered her severely debilitated such that she suffered heat stroke/hyperthermia while the building’s air-conditioner was not operating. Building temperatures were allowed to rise above 95 degrees Fahrenheit. Three other residents died in this nursing home within 24 hours of plaintiff’s decedent--also due to complications from hot environmental temperatures
