Client was charged with 1st degree armed robbery in Greene County and in Polk County. The vehicle the client was in was stopped by police and the stolen money and mask were found in the vehicle. I was ... able to convince the prosecutor my client was just in the wrong place at the wrong time and to ultimately dismiss both cases.
OUTCOME: Case was dismissed
Client was charged with child molestation in Pulaski County, MO. When I took over the case my client was being held without a bond. I successfully got the case moved to a new judge and convinced that ... judge to set a reasonable bond. At that point he was able to bond out of jail. After extensive negotiation and trial preparation the prosecutor dismissed the case.
OUTCOME: Sentence reduced
2010: The defendant was falsely accused of creating child pornography by the U.S. Attorney's office. The case went to trial where the U.S. District Judge threw out the actual charges of creating chil ... d pornography for a lack of evidence. However, the judge allowed the jury to consider whether he attempted to create such videos. The jury found him guilty of attempt. I filed a motion to have the judge overturn the jury's verdict, which he did, citing that there was insufficient evidence for the jury to have convicted the defendant even of attempt and overturned the jury's verdict. By not giving up even after a jury conviction, he was acquitted of a crime he did not commit. Unfortunately, the Government appealed the court's ruling and it was overturned by the appellate court. We did not give up and his 10 years sentence was eventually reduced to 6 years.
OUTCOME: Dismissed by State
Client was charged with the Class B felony of manufacturing methamphetamine. Client was looking at 5 - 15 years in prison. I realized that the State did not have a legal or factual basis for the charge ... and deposed several of the police officers involved in the raid. As a result my client and I pushed the State to trial, confident in our case. Just prior to trial the state dropped the charges. My client is a free person and did not get saddled with a felony record.
