Fletcher v. Martarano et al

OUTCOME: Plaintiff’s verdict $600,000 plus $186,000 arrorney’s fees; settled for $850,000 after appeal

Civil Rights and excessive force case due to tasing and beating Mr. Fletcher, by St. Louis City police officers. Mr. Fletcher was falsely arrested, beaten and tased and thrown in jail. He had severe t ... rauma to his face, back and arms after officer Matrarano and Officer Motin bet and tased him. All charges against Fletcher were denied by the prosecutors. He suffered wounds from being struck by the fists and batons and tasers of the police. He sued in Federal Court and Mr. Tatlow obtained a $600,000 verdict against two officers, after settling with the jail, the jail Doctor and nurses for an undisclosed amount. After trial Judge Ronnie White awarded $186,000 in attorney’s fees and costs. The City officers appealed and the Court of Appeals 8 th Circuit affirmed the judgment and Mr. Tatlow moved for all of his fees on appeal. The City and officers settled after losing the appeal for $850,000. Mr. Tatlow had demanded $100,000 to settle before trial and Defendants had only iffered $12,000 to settle the case.

OUTCOME: Payment of full policy limits of life insuance

D.H. was a beer brewer that retired in 1996 after having a variety of health problems. In 2008 he learned that other employees had been getting paid their life insurance benefits under a clause if they ... were disabled the company had to buy-out the life insurance. He contacted Mr. Tatlow who had handled over 100 similar cases. He proceeded forward and claimed that the insurance company and the employer breached their fiduciary duty to him due to not providing him with the plan documents. Because it was now 2011 and 15 years after retirement the insurance company refused to let him apply because the time to do so had expired. Mr. Tatlow filed complaints with the Division of Insurance and after months of arguments, the insurance company and Anheuser Busch eventually agreed to evaluate the claim. After reviewing the written documentation provided, they paid their full policy limits before suit was filed.

M.S. v. Anheuser Busch and Prudential Insurance Company of America

OUTCOME: Award of policy limits of $100,000

M.S. was a security guard at Anheuser Busch Companies, Inc. and a former police officer. She obtained a life insurance policy at Anheuser Busch, with Prudential Insurance Company of America. The ERISA ... policy provided that provided that if she was disabled under the terms of the plan from her job and any other job that the company would pay her the total amount of her life insurance policy. M.S. applied for the benefits and the insurance company, Prudential Insurance Company, denied the claim and argued that she could still perform her job as a security officer. After Mr. Tatlow became involved he appealed the denial and obtained an award of the entire amount of the benefits for his client. He convinced Prudential Insurance Company that M.S. had to quit work due to carpal tunnel syndrome, knee problems, back pain and hip pain. He successfully argued that these problems all prevented her from shooting a gun, chasing a suspect and subduing a suspect with force. The company agreed to pay the entire policy prior to a lawsuit being filed.
