Filed suit for the UW against its custodial bank for breach of contract and breach of fiduciary duties incidental to custodial and securities lending agreements with potential exposure in the hundreds ... of millions of dollars range due to existing and future losses associated with the North Trust managed securities lending program. Obtain a TRO and later Preliminary Injunction against Northern Trust Bank prohibiting its actions under both the custodial and securities lending agreements and later terminated the contracts with nominal costs associated with the same. To date, this is the only known injunction issued to prohibit a bank from loaning out pre-promised securities of one of its custodial clients and requiring a return of all loaned securities to the clients custodial account which then allows the UW to dismiss the lawsuit
