State of Kansas v. Valerie Baker
Jan 10, 2019OUTCOME: Won at the Court of Appeals and made new law.
Ms. Baker hired me to represent her on her probation violations in Johnson County, KS. After an exhaustive review of her case file, I determined that the State of Kansas did not have jurisdiction on tw ... o of the three charges she was on probation for. I filed a motion and brief challenging the jurisdiction issue. The trial court denied my motion, revoked the probation, and sent Ms. Baker to prison for all three charges. We appealed. The Court of Appeals issued an opinion in State v. Baker, No. 118,338, agreeing with our position that the State did not have jurisdiction on two of the charges. She was released from custody without having to serve any additional time.
