Prior to trial, Mudd forced the metropolitan municipality to admit that its sewer treatment facility did not afford the sewage capacity it had promised to provide under the written agreement, and that the involved sewage back-ups were the result of the lack of capacity at the treatment facility. Following those admissions, the metropolitan municipality fully settled all of the claims being made by each of the homeowners - Mudd's client did not make any settlement payments, and all claims against Mudd's client were dropped.
