Our clients were a City and supervisors who were sued by a codes inspector. The codes inspector's employment was terminated when his superiors found he was violating codes he was supposed to be enforci ... ng. He was also prosecuted for the code violations. The codes inspector sued alleging he was wrongfully terminated and prosecuted. We obtained a summary judgment, which the employee appealed to the Eighth Circuit. The summary judgment was upheld on appeal, and the United States Supreme Court denied the employee's petition for writ of certiorari.
OUTCOME: Summary judgment for client, affirmed.
Our clients were sued by an employee who claimed he suffered retaliation in violation of his First Amendment rights. During the employee's deposition, we were able to establish that the employee's spe ... ech was not "a matter of public concern", which was fatal to his claim. We obtained a summary judgment for our clients, which was upheld on appeal.
