Focusing on the clues from the vehicle while in Motion, to the clues of making contact with my client, to the performance of the field sobriety test, it became clear that the Court did not hold the Trooper to be credible. As a result, the Judge found my client not guilty.

Petitioner, represented by ... Bert Fulk, filed a Petition to Review to challenge the revocation of his license. At trial, Bert Fulk was able to elicit evidence that Petitioner did not knowingly refuse the breath test and that the arresting officer coerced Defendant into refusing the test. As a result, the Court found for Petitioner and ordered the revocation of Petitioner's driving privileges to be overturned.
