May 17, 2007OUTCOME: Client won her appeal, resulting in a remand of her case for a new hearing. Client won her benefits at a subsequent administrative hearing.
The United States Court of Appeals for the Eighth Circuit reversed the Commissioner of the Social Security Administration and remanded this case for a new hearing where client won her Social Security d ... isability benefits. This was a fibromyalgia-related disability case in which the diagnostic challenges for this disorder are discussed. Court held ALJ failed to properly credit the favorable opinions of treating medical providers and exaggerated the vocational significance of certain daily activities. This case has been cited by a large number of subsequent cases, including Kirby v. Astrue, 500 F.3d 705 (8th Cir. 2007) and Papesh v. Colvin, 786 F.3d 1126 (8th Cir. 2015). It was my honor to represent the Plaintiff, Patricia Leckenby, at each level, including the appeals to the U.S. District Court and the U.S. Court of Appeals.
