H1B RECAPTURE

At the end of the client's 6th year in H-1B status (with only one month left before her visa expires), client came to me for assistance. After the 6th year of an H visa, individuals can file for 1 year ... extensions in H-1B status only if there is a labor certification or I-140 that has been pending for over 1 year. Client had not filed any labor certification in her 5th year. It appeared Client would have to go home with no viable alternatives for reentry. However since the client was a teacher and had school holidays, I was able to argue that she was not officially in H-1B status during those days. I was able to “recapture” her days outside of the United States and have her H-1B status extended for that time period. This allowed client's employer to file a labor certification on her behalf so that she would qualify for a “7th year extension” based on the pending labor certification. Client will be allowed to stay in the United States in her H1B status. She could file her labor certification in time, allowing for indefinite 1-year extensions of H-1B status.
