OUTCOME: Not Guilty
Mr. Sluder's Client was charged with Reckless Driving, Driving While Impaired, and Impeding Traffic in Henderson County. Case was called for trial and defendant found not guilty, based on an issue reg ... arding the identification of the impairing substance. Other related charges were eventually dismissed by the District Attorney
OUTCOME: Dismissal
Often the best results in a case come not from trial, but from resolving the case before trial. I have won and lost at trial, but countless times I have prevented my client from ever being exposed to t ... he risk associated with a trial. The District Attorney is a lawyer also. And in most cases, once the facts and the law are expressed to a good district attorney, the DA may see that prosecuting the case as charged does not serve the ends of justice. I am always preparing for trial, but aiming for this outcome- Trial is always a gamble. I like a sure thing. If a client has a good case, one that I believe we can win at trial, I prepare to take that case to trial. I never show all my cards prior to trial, but often show a good enough hand to the DA and reach the resolution my client and I decided would be a victory prior to spinning the roulette wheel that is a trial.
