During a traffice stop, police found marijuana during a pat-down search for weapons. The trial court denied Mr. Rybolt's motion to suppress and an interlocutory appeal was granted. The Court of App ... eals agreed that a pat-down search for weapons where the officer had no reasonable suspicion that Mr. Rybolt was armed and dangerous violated the Fourth Amendment. The trial court's denial of Mr. Rybolt's motion to suppress was reversed.

Perry v. State

OUTCOME: Eighty year sentence was reduced to fifty years.

This was an appeal of a sentence only. Mr. Perry was convicted for Dealing in Cocaine and Conspiracy to Commit Dealing in Cocaine and sentenced to thirty years on each count, to be served consecutiv ... ely. He was also convicted of being an habitual offender and sentenced to twenty additional years. Mr. Perry's total sentence was eighty years. On appeal, Ms. Rayl successfully argued that an aggregate sentence of eighty years was manifestly unreasonable. The Court of Appeals agreed, and ordered the two sentences to be served concurrently for a total of fifty years.
