J1 Hardship Waiver
Nov 01, 2013OUTCOME: Approved
Our client, a student on a J-1 visa, was married to a U.S. citizen and had U.S. citizen children. We argued that enforcing the two-year home residency requirement would create extreme hardship on the ... U.S. citizen spouse and children, including interruption of the spouse's career, separation of a mother and an infant, and serious economic consequences. We carefully documented the potential financial hardship the family would face, as well as the country conditions.
