Mother took children to Las Vegas, NV during the Christmas Holiday in order to be with another man. Mother had no plans to return to PA. Father filed an Emergency Custody Petition to return to PA, wh ... ich was granted. Father also sought to be the primary custodian of the children, which was also granted after trial.

Philadelphia resident Maharji Hemingway was charged with being a $1,000,000.00 supplier of cocaine to Clearfield County. Mr. Hemingway was one of 13 other co-Defendants as part of "Operation Drive Thr ... u" as dubbed by the PA Attorney General's Office. The Attorney General had been investigating this drug ring for three years and used two investigative grand jury panels. The trial was set for seven days. Mr. Hemingway's defense was that the Commonwealth had the wrong guy, i.e., while the cocaine supplier may have been a 'black man from Philadelphia,' our point was the investigation revealed that 'any black man will do.' Prior to trial, Mr. Hemingway, as well as the co-Defendants were consistent that the Commonwealth was less than forthcoming in turning over witness statements and information that we believed we were entitled too. Finally, the Judge ruled that certain information needed to be turned over by a certain date. When the Commonwealth failed to turn over this information, we filed a motion a motion to preclude the Commonwealth from introducing certain testimony. The Judge agreed and on the first day of trial, July 13, 2009, prevented approximately 34 people from testifying. The Commonwealth is currently appealing this decision.
