OUTCOME: Reversed and Remanded

Estate and statutory beneficiaries of nursing home resident brought claims against facility for wrongful death and violations of the Adult Protective Services Act (APSA). The trial judge dismissed clai ... ms as subject to arbitration. After we appealed that holding, the Arizona Court of Appeals reversed the trial judge and held: (1) explicit language in arbitration agreement binding resident's heirs as to wrongful death claim could not be enforced and (2) where the resident had multiple respite stays at the nursing home, those arbitration agreements signed for first two admissions to facility did not govern claims arising out of resident's subsequent two admissions, for which no arbitration agreements were signed.
