Creditor sued Chapter 7 Client in adversary proceeding for non-dischargeability under 11 U.S.C. §523. This particular creditor has a nasty history of filing suit because it believes that most debtors ... will default or settle, rather than fighting the charges. I never allow this in my clients. We filed a motion to dismiss pursuant to F.R.C.P. 12(b)(6) and F.R.B.P. 9, and was successful after oral arguments before the court. My client also did not have to pay any of my attorney's fees, as I proved the original complaint to be lacking, and forced the creditor to pay my fees.
OUTCOME: Appeal Dismissed
Chapter 7 client was sued in adversary proceeding for fraud under 11 U.S.C. §523 using baseless charges. We filed a dismissal action and won at the BK court level. Adversary petitioner then appealed t ... hat decision to the 9th Circuit Bankruptcy Appellate Panel, which dismissed his appeal upon my Motion to Dismiss based on lack of personal jurisdiction and lack of foundation.
OUTCOME: Settlement
