OUTCOME: Not guilty

Client was charged with attempt to elude with the endangerment enhancement, possession of a dangerous weapon, and bail jump. The eluding was on video showing him going over 115mph on a motorcycle cross ... ing a busy highway. The states offer was 51 months. At trial we received a hung jury on the elude but guilty on the lesser of failure to obey which means he cannot he retried and is only looking at 90 days. The remaining charges were found not guilty!

Mr. Glatt was charged with a second offense DUI and DWLS 2nd and was alleged to have a BAC of 0.291. I successfully challenged law enforcement's basis to stop his vehicle, the City conceded the issue ... and both charges were dismissed!

Client charged with DUI after failing FST's and provided a BAC of .145, .138. I was able to successfully show the jury how the test was biased because the longer you blow the higher the test results w ... ill be and that the Trooper was the one who determined what the results would be by how long he coached Mr. Cross to blow. I was able to show that if Mr. Cross had blown for only the minimum time needed for the machine to accept his sample, his BAC would have actually been 0.068. After deliberating for over an hour the jury returned a verdict of Not Guilty!

After suc ... cessfully suppressing a portable breath test reading of 0.16 the Judge held that the officer lacked probable cause to arrest and dismissed the charge with prejudice.
