DUI case went on a deferred prosecution with another lawyer. Client was seen drinking at a bar by his alcohol counselor, who reported him to probation. Phil asked the judge to take a recess and look ...at whether the initial finding of probable cause (“PC”) was valid, which Phil told the judge it was not. Judge returned from recess, agreed, and dismissed the entire case, despite the obvious current probation violation of consumption of alcohol while in treatment and on active DUI probation for a deferred prosecution.
Young client together with his friends arranged to beat up a minor and wannabe gangster for stealing from the client. Victim was met on a pretense at a school, punched, kicked in the head repeatedly, ...and his belongings taken. Over a year of negotiation, extensive medical and psychological forensic evidence was presented. Initial charging decision of Attempted Murder avoided, then Strongarm Robbery and Strongarm assault charges dropped, then only Theft 1 with 20 days jail remained. At sentencing, the prosecutor explained to the judge that this was an exceptionally light sentence for the facts present but emphasized Attorney phil Weinberg’s relentless negotiation and hard work documenting client’s unique issues and extenuating circumstances, telling the judge it was a fair disposition. Phil’s intensive work had been done over the preceding year so by that point, he didn’t even have to say too much. An amazing offer and plea deal was accomplished that avoided perhaps 5 to 12 years in prison or more for Phil’s client.

Phil defended one of two co-defendants caught dealing heroin and meth out of a motel in Aberdeen that had a school zone bus stop across the street from and close to it. DEA, FBI and local law enforcem...ent Drug Task Force conducted surveillance of these individuals for months as they brought huge amounts of these drugs here from another state. The county drug prosecutor had thousands of pages of surveillance reports and massive video surveillance evidence, and she wrote a letter saying these two had “enormously fueled” the drug problem in that county, which then had no drug court. These guys were caught red-handed with more than a pound of each drug. There were no viable suppression motions available and the initial plea offers were very tough. Also, the US District Court prosecutor in Seattle threatened to take the case federal and give each defendant 20 years in federal prison. Phil successfully negotiated a 2-year prison term for his client. All told, a great deal for Phil’s client considering what might have been imposed.

Phil’s client had no prior drug charges but was caught in a hotel with over 4 pounds of heroin that was smoked with an informant. A gun was found by police triggering a possible 2-3 year weapon enhance...ment sentencing add-on. The total prison time Phil’s client was looking at was about 7 years. Phil negotiated a deal for just one year and no gun enhancement.

Client repeatedly relapsed on alcohol and drugs, and got new criminal charges too, after Phil got client an SOC on DV Assault 4 and malicious Mischief 3 (property destruction) non-felony charges and a ...deferred prosecution (“DP”) on his/her DUI charge. Phil saved his/her SOC and DP from being revoked numerous times at review hearings, getting the judge to give him/her another chance multiple times. After the representation ended, though, another attorney was not so lucky for client when he/she later relapsed again.
