This was a False Claims Act lawsuit brought by a relator. It also alleged violations of the American Reinvestment and Recovery Act ("ARRA"), the Virginia Fraud Against Taxpayer Act, and the D.C. False ... Claims Act. As part of the legal team assigned to the case, I drafted the motion to dismiss, handled the processing and review of the documents, and assisted with the revising and editing of the settlement agreement.

The firm handled the appeal to the Defense Office of Hearings and Appeals for a prominent individual who had been denied a renewed security clearance. The initial denial was based on a prior debarment ... and family connections to a foreign country. I drafted the challenge to the denial as well as the closing statement in support of granting the security clearance.

Boye et al. v. United States

OUTCOME: Victory

Plaintiffs, employees of the Navajo Department of Public Safety, brought a lawsuit in the Court of Federal Claims alleging that the Bureau of Indian Affairs had failed to ensure that the Navajo Nation ... complied with the conditions of the contract. I argued that, under the Indian Self-Determination and Educational Assistance Act, the employees could not be third party beneficiaries of any contract between a Native American Tribe and the BIA. I completed the final round of briefing and argued before the United States Court of Federal Claims. Afte the Court of Federal Claims granted the motion to dismiss, the plaintiffs appealed. I wrote the appellee response brief and conducted the oral argument before the United States Court of Appeals for the Federal Circuit. I again prevailed.

An incumbent contractor sought to challenge the Air Force's decision to use employees rather than contractors after the end of the contract. The contractor brought the lawsuit in the United States Dis ... trict Court for the Western District of Texas. I wrote and filed the appellate response brief that successfully argued that the Administrative Disputes Resolution Act vested subject matter jurisdiction only with the United States Court of Federal Claims.

Resource Conservation Group LLC v. United States

OUTCOME: Victory

The United States Naval Academy wanted to lease its dairy farm to generate revenue, and sought proposals. The plaintiff submitted a proposal, but the Navy rejected the proposal as non-responsive. The ... plaintiff then sought to challenge the decision as a bid protest brought under the Implied Contract of Fair and Honest Consideration in the United States Court of Federal Claims. I first convinced the Court of Federal Claims that the court no longer had jurisdiction to consider bid protests brought under 28 U.S.C. 1491(a) and the older theory of "fair and honest" consideration. Although this was reversed, I then wrote the briefs and orally argued a subsequent motion to dismiss, alleging that the Navy properly rejected the bid. The plaintiff again appealed. I wrote the primary appellee brief and argued the appeal before the United States Court of Appeals for the Federal Circuit. I prevailed.
