Represented Husband in Equitable Distribution, Support and Custody Trials
Jul 10, 2019OUTCOME: Favorable Rulings for Husband on Equitable Distribution, Support and Custody
Mr. Tank represented a husband in five trials in 18 months and won each time. First, he obtained an excellent ruling from the judge after an equitable distribution/support trial in February of 2018. Th ... e judge ordered husband to pay spousal support in an amount that was less than half of what the wife was demanding in settlement. The husband was also allowed to keep 100% of his pension. Later that year the wife filed a motion to increase the husband’s spousal support. After a trial the judge denied the motion and ordered the wife to pay most of husband’s attorneys fees. In a subsequent trial on the husband’s motion to decrease his child support, the judge imputed income to the wife on the basis that she was voluntarily under-employed. In November of 2018, Mr. Tank represented the husband for a custody modification trial. The parties had previously shared custody by agreement, but the judge ruled that there had been a material change in circumstances and that the ex-husband should have sole legal and physical custody of the child. Shortly after the trial the wife attempted to regain custody by fraudulently accusing husband of abuse of the child, even attempting to kidnap the child from a public place near the husband’s home out of state. Mr. Tank filed an emergency motion to suspend ex-wife’s visitation, and transfer the case to ex-husband’s home state for further proceedings. The court granted that request after three days of trial concluding on July 10, 2019.
