The Defendant was a passenger in a car that was stopped for speeding. The Defendant got out of the car while they waited for the officer to check their identification. Once the officer issued the dri ... ver a ticket he told the pair they were free to leave. The Defendant headed back to the car but the officer stopped him for additional questioning. That questioning lasted for ten minutes while other officers who had arrived on the scene later questioned the driver. A canine performed a perimeter search of the car and alerted to contraband. A weapon and drugs were found in the car. The Defendant filed a motion to suppress the fruits of the search on grounds that the officer's lacked probable cause to detain the Defendant for an extended period of questioning after he told the pair they were free to go.
