Kelly, are co-counseling this case (and doing almost all the work) and in addition to investing large amount of their firms’ time into this case they actually hired another law firm to handle the appeal for us and represent us in another class action in South Dakota. This is an important victory against a large abusive internet lender and the abuse of mandatory arbitration clauses in contracts that seek to take away our rights.
OUTCOME: Judgement Against Credit Reporting Company
Virginia consumer lawyers have scored a judgment worth nearly $12 million in a class action against a credit reporting company that deliberately obscured sources of information on credit reports. The ... misleading information likely hampered consumers trying to discover the sources of unfavorable credit data on their reports. The agreed judgment followed a ruling last year from U.S. District Judge John A. Gibney Jr. that Experian Information Solutions Inc. had committed a willful violation of the Fair Credit Reporting Act. The settlement calls for a payment of $170 each to 69,103 consumers, according to the judge’s order and information from attorneys in the case. The total payout comes to $11,747,510.

Sixty-two individuals (collectively "Plaintiffs") have brought both individual and class claims against the Law Offices of Shapiro, Brown & Alt, LLP ("SBA") and Professional Foreclosure Corporation of ... Virginia ("PFC") (collectively "Defendants"), alleging that Defendants violated both common law duties and various Fair Debt Collection Practices Act ("FDCPA") provisions when foreclosing on Plaintiffs' homes. At issue here, Plaintiffs allege that Defendants breached their fiduciary duty to Plaintiffs by proceeding with foreclosure without satisfying all conditions precedent to the foreclosure. Additionally, Plaintiffs allege that Defendants violated both their common law fiduciary duty and the FDCPA by charging e.xcessive title examination fees related to those foreclosures. Opinion obtained allowing borrowers to sue for excessive title fees.
