OUTCOME: Not Guilty on Conspiracy and Reduction of Murder to 2nd Degree

Because of my extensive experience as a prosecutor in violent crime, once I went into defense practice, I was appointed by the Court to be lead counsel and assist in the defense of of a local man who h ... ad charges of First Degree Murder and Conspiracy to Commit Murder. This case had become the "talk of the town" so to speak with its portrayal by the media and the allegations of multiple confessions by my client. We aggressively defended our client by filing and arguing a number of lengthy motions hearings.. With a jury trial looming and an unwavering commitment to make the prosecution beat us at trial or make a reasonable offer, the prosecution offered to dismiss the conspiracy charge and reduce the murder charge to Second Degree Murder. Following a sentencing hearing, I successfully argued for the Court to sentence Mr. Peck toward the middle of the recommended sentencing guidelines for the lesser charge. What could have been a sentence of 20 to life, resulted in 19 years. When an attorney has extensive trial experience, is confident in their abilities, and wiling to put in the time and effort, one can often achieve a favorable result for their client.
