Client was charged with Aggravated Assault, attempted Rape w/weapon, attempted sexual assault, burglary, unlawful restraint, and related offenses that would permit decades of incarcerration if convicte...d at trial. In November 2012, my client was arrested following an alleged incident in a laundry room in the apartment complex where the complainant resided. The police were called by another resident and the complainant claimed to have been the victim of an attempted rape at knife point by my client, whom she said was a complete stranger. A few months later, the complainant testified about being assaulted and almost raped by the defendant. In the 19 months leading to the trial date, I conducted a vigorous investigation to develop evidence that had the potential to completely discredit the complainant. After months of work and effort, I was able to produce, with the assistance of a forensic cellular communications expert, a digital image of all the data contained on my client's phone in a report format that ultimately showed that my client and the complainant had been in contact with each other prior to the incident and had arranged to meet that evening of the arrest. Ultimately, the case was nolle prossed(dismissed completely) after 20 months of hard work, perseverance, and a commitment to my client that remained incarcerated on a fabricated story by the complainant. Al thought this case was resolved prior to trial, the complete nolle pros(withdrawal) of a rape, aggravated assault, burglary case as a result of my continued motivation, effort, and commitment to my client as his attorney. This case continues to support and confirm my personal beliefs on the role and responsibility an attorney has in the legal profession and that there is no substitute for hard work.

The Commonwealth alleged that my client and his co-defendant got into a verbal argument with a few people from the neighborhood over the theft of a phone and marijuana. Ultimately, the Commownealth cl...aimed that my client and co-defendant each fired a handgun at approximately 4 people striking only 2. One of the 2 resulted in serious injuries reuquiring numerous months of treatment and surgeries in the hospital to recover. The other individual was hit was a bullet fragment in his chest and was released from the hospital the same day.

OUTCOME: Jury Trial - Not Guilty of the attempted murder, aggravated assault, assault of law enforcement by firearm on 7 alleged victims
The Commonwealth alleged that my client brought a firearm over to the house of his girlfriend and two children under age 3, held her hostage with firearm to her head, shot multiple shots near her, fire...d numerous shots at another family member, and held her at gunpoint with 6 SWAT Team officers on scene. Eventually, the 6 SWAT officers breach the room where my client was located and were fired upon by him. A SWAT officer fired his assault rifle striking my client in the head causing a non-life threatening injury. The Commonwealth proceeded on assault of law enforcement by firearm on the 6 SWAT officers. If found guilty, each conviction carried at mandatory 20-40 year sentence per officer.
