I represent the plaintiffs in a wrongful death lawsuit against the Washington Department of Corrections after the Department improperly released a mentally ill inmate who then murdered two people.
OUTCOME: Negotiated settlement
fter police concluded that three-year old Ashley McLelland died in an accidental drowning, I was hired by Ashley’s biological parents to sue her stepfather for wrongful death. Although the trial court ... , relying on the doctrine of parental immunity, dismissed the suit, I was able to convince the Washington Supreme Court to reverse the dismissal. A settlement was subsequently secured for my clients. I then provided prosecutors with sufficient evidence to charge and then convict Ashley’s stepfather of intentionally committing her murder.
