OUTCOME: Full custody granted to father

Department of Human Services filed a Dependency & Neglect case on a newborn baby based solely on the mothers past. There were no current circumstances indicating she was a danger and father, my client ... , had no history at all. Neither the Department or Guardian Ad Litem was willing to consider father as a placement for his daughter. We took the case to jury trial an father won. He was ultimately & rightfully awared full custody of his child.

OUTCOME: Full custody granted to grandmother

Biological parents both knew they could not care for their daughter on thier own and gave custody of her to the paternal grandfather. After many years of difficulty having their court ordered contact ... with their child, parents became increassingly suspicious and concerned about grandfather's safety with the child (allegations of severe emotional abuse) and sought to have his custody terminated and allow her to move to the grandmother's custody instead. Grandfather pushed the case all the way to a contested hearing, denying all allegations. Our court appointed investigator/expert testified that she felt the allegations were legitimate and that the child was unsafe with grandfather and that she wanted to move to live with the grandmother, who had also been denied access for years. Court agreed with the investigator and awarded my client, the grandmother, custody and fully terminated the grandfather's parental involvement based on the investigators documented concerns.
