OUTCOME: Not Guilty (all counts)

Our client was charged with attempted murder after shooting the alleged victim 3 times in the back and one shot into the door frame as the alleged victim was running out of the home. At trial, the Defe ... nse argued that Mr. Belliveau was not the initial aggressor as presented by the State, but that he was accosted in his own home by his estranged wife's paramour. Defense was able to establish through slowed-down video evidence that he was brutally attacked and that he fired on his attacker to protect himself and his family. After a five-day trial, the jury returned a verdict of Not Guilty on all counts.

OUTCOME: Not guilty

Our client was charged as a Three Time Convicted Felon in Possession of a Firearm. At trial, we argued that the State did not have sufficient evidence to show that our client was ever in possession of ... a gun. We effectively cross-examined the State's witnesses and made a strong closing argument for our client. The jury returned with a NOT GUILTY verdict and our client was acquitted of the charge. Mr. Ivery was facing a possible life sentence.

OUTCOME: No criminal charges, client released.

My client hired me after being arrested and charged with DUI and 2nd Refusal - while he was on supervised release from DOC. He had served 8.5 years on a 10 year DOC sentence and a violation would put ... him back to finish 1.5 years. My client refused field sobriety exercised and urine, but blew 0.00. The officer suspected drug use. Client was placed in the county jail with no right to see a judge because he was under DOC supervision. During this time, I had the DUI reduced to a civil infraction (Careless Driving) and the Refusal was dismissed by the State. After attending and arguing on my client's behalf at the FL Parole Board Hearing, the Board recommended that my client be released from custody and his State supervision be terminated.

OUTCOME: 4 Counts of Attempted Murder were all reduced to Aggravated Assault (3rd Degree Felonies)

My client was charged with 4 counts of attempted murder after firing a gun out of a vehicle. The State insisted that the gun was fired in the direction of 4 people; however, my ballistics expert conclu ... ded that there was no way the gun was fired directly at the witnesses. After intense negotiations with the State and depositions with all State's witnesses, the prosecutor reduced all charges to aggravated assault with a DW. My client was sentenced as a youthful offender and was give 2 years jail (credit for one year served) followed by 3 years probation. He was also given the option to go to work camp, which cut his jail time nearly in half.
