Represented multiple national financial lending institutions in litigation and alternative dispute resolution capacities for consumer collection matters, resulting in millions of judgments and stipulat ... ed settlement agreements. Obtained numerous pre-suit full value payments of the balance owed for a nationwide medical supply company. Negotiated a settlement agreement for 15% of the suit amount for a local small business owner, which resulted in the dismissal with prejudice of the pending civil action. Conducted various methods of post-judgment activities, including depositions in aid of execution, bank and wage garnishments, to collect hundreds of thousands of dollars in consumer and commercial debt. Defaulted and/or terminated numerous automotive repair franchise agreements, negotiated payment of the outstanding royalty balances and litigated breaches of the agreement for violations of a non-compete. Recovered over a million dollars in consumer and commercial debt through pre-suit negotiations, litigation and post-judgment execution. Represented out-of-state individual and commercial creditors in domesticating foreign judgments and defending an action to contest the foreign judgment. Advised local homeowner’s association of the various methods of post-judgment collection and the statutory methods and requirements for executing on a judgment, including counseling on the likelihood of success for each method based on information obtained from a thorough asset and lien search. Successfully tried County Court cases for breach of contract, account stated and open account in various creditor’s rights actions against individual consumers. Defeated a motion for proceedings supplementary and obtained an order of the court requiring the judgment creditor to vacate a domesticated foreign judgment. Facilitate recovery of past due condominium assessments from initial demand through lien foreclosure actions.
