An underinsured motorist was traveling in the opposite direction and negligently entered the southbound lane as he was distracted while ... reaching for his sunglasses. He drove directly into client's vehicle, which was then knocked into a ditch on the side of the road. Injuries were significant and included a fracture to the zygomatic arch (side of cheek bone) which required surgery; fracture of the left maxillary sinus (located below the eye, on the cheekbone) which required surgery; comminuted fracture of inferior and lateral walls of the left orbit eye socket which required surgery; displaced acute fracture of the coronoid process of the mandible (top border of the jaw bone) which required surgery; subcutaneous emphysema (when air or gas gets under the skin) of the left cheek and eyelid; traumatic brain injury with loss of consciousness at scene; partial loss of taste; partial facial paralysis; neck and upper back strain; and bilateral knee pain and contusions.

L.V. worked as an ordinary seaman on the Cathlamet and Kittitas, two ferries owned and operated by the Washington Department of Transportation, Division of the Washington State Ferries. One of her dai ... ly duties included buffing the floors with a buffer machine. L.V. claimed the machines on both vessels were broken. On one, the throttle was defective and had to be held in the full on position with tape. The other had wheels missing. Consequently, she said, the machines were difficult to control and required extra effort by the operator. These defects were brought to the attention of her superiors, L.V. claimed, but they refused to fix the machines or allow her to refrain from using them until they were in proper working order. L.V. claimed she sustained a back injury while working on the two vessels in April 1999. Her injury rendered her permanently partially disabled, she said. L.V. and her husband Ron filed a lawsuit in Snohomish County Superior Court against the state and its Department of Transportation, Division of the Washington State Ferries. The couple alleged the state and agency were liable for compensation, maintenance and cure for the back injury L.V. sustained on the job. The defendants refused to provide maintenance and cure, the couple claimed. L.V. and R.V. added claims of Jones Act negligence and unseaworthiness of the vessels. The couple argued the state and agency failed to provide a safe working area and equipment; failed to inspect, maintain, replace or repair defective and unsafe equipment; and failed to man and train the officers and crew properly. The couple sought damages for permanent partial disability, lost wages, medical expenses, loss of past and future enjoyment of life, pain and suffering, and emotional distress. The state and the Department of Transportation answered together and denied liability. They cited failure to mitigate damages and comparative fault as affirmative defenses. The parties stipulated to a dismissal of R.V. as a plaintiff, leaving only L.V. as a plaintiff for the bench trial that occurred. Judge Ellen Fair presided over the trial and rendered a judgment in favor of the remaining plaintiff Dec. 10, 2008. Judge Fair awarded L.V. $195,653 in damages, plus $424 for costs and attorney fees.

S. S.L., along with four minor passengers, was driving south on Southcenter Parkway, Dec. 27, 2005, when M.E.'s vehicle struck the S. S.L. vehicle from behind. S. S.L.'s vehicle was reportedly totaled ... as a result of the collision. S. S.L. claimed she sustained injuries to her neck, shoulder, back, buttocks, legs, and headaches as a result of the collision. According to S. S.L., her back injury required surgery. S. S.L. filed a vehicle negligence lawsuit against M.E. and her husband, W.E., in the King County Superior Court. The plaintiff alleged M.E. was negligent in failing to keep a safe distance, failing to control her speed, failing to take proper evasive action, and failing to operate her vehicle in a safe manner. The plaintiff sought damages for her injuries, over $31,000 in medical expenses, emotional distress, pain and suffering, loss of enjoyment of life, $97,000 in lost wages, and $184,000 for loss of future earning capacity. She also requested monetary compensation for property damage and loss of use of her vehicle. During the proceedings, the defendants admitted liability for the collision. A jury empanelled before Judge Andrea Darvas returned a verdict in favor of the plaintiff Sept. 1, 2010. The plaintiff was awarded $136,000 for past economic damages, $88,500 for future economic damages, and $50,000 for past and future noneconomic damages.
