Cheri Little and Donald Little owned a plastics company. During the pendency of the divorce, Cheri Little entered into an agreement to transfer a substantial portion of the assets of the company to he ... r brother, who would open a new company and make her part owner of that company once the divorce was final. The transfer of marital assets was done unbeknownst to the husband. After the divorce, wife filed a complaint against her brother alleging breach of contract and describing the property transferred to her brother. Husband filed a Motion To Vacate the Marital Settlement Agreement and Reopen Proofs once he discovered the filing of the complaint. The Court dismissed husband's Motion to Vacate the Marital Settlement Agreement and husband appealed.
