Nov 18, 2021OUTCOME: A four day jury trial, decided in favor of our clients (Defendants) and against Plaintiff on all claims. Jury awarded damages on all counts, plus punitive damages, and all costs of the trial.
We were counsel for the defendants. Parties were business partners in an LLC formed to renovate homes and sell at profit. Disputes arose as to the use of company funds and other management matter ... s. Defendants moved to exclude the Plaintiff from company funds and management by a vote. Plaintiff sued (derivative on behalf of LLC) claiming that defendants had misused company funds and attempted to illegally exclude Plaintiff from the company. Defendants counterclaimed, alleging that plaintiff had actually misused funds, converted company funds, and had committed acts of dishonesty. Defendants asked the court for money damages, punitive damages, and to expel the plaintiff from the LLC. Jury decided in favor of our clients (Defendants) and against Plaintiff on all claims. Jury awarded damages on all counts, plus punitive damages, and all costs of the trial. This punitive damages in this matter was one of the largest by ratio (17:1) in Virginia.
