OUTCOME: We were able to have the child brought back and reunited with the mother. after months of litigation it was finally determined that the child was to remain with the mother in NY.

I received a frantic phone call from a mother that the father picked up their daughter for his usual visit and never returned her. further, the father, who was living in Staten Island, with his sister ... and his wife, had suddenly not been living with the sister and moved to an unknown location. As it turned out, the father actually moved to another State.

OUTCOME: sellers had to pay for the installation, even though the buyer closed without this installed. when there is a post possession, the warranties that the seller makes will survive closing through the possession date if said date is later than the closing.

We represented clients that were buying their first home. In the Contract there was a Post possession agreement. At closing one of the agreed terms, were to replace something that was broken. T ... he sellers failed to install the replaced item, and simply left it in the home. At the closing, the buyers did not get possession as the sellers had 7 days to give possession post closing.
