Attorney Mary Markovich, on behalf of Sleep Analysis, Inc., petitioned the NC Respiratory Care Board for a Declaratory Ruling to interpret NCGS 150B-4, regarding the activities of Polysomnographic Tec ... hnologists, Polysomnographic Technicians, and Polysomnographic Trainees working in hospital-based and free standing sleep centers. Under the circumstances enumerated in the Petition, the Board concluded in the Declaratory Ruling that, pursuant to NCGS 90-664(1), Polysomnographic Technologists, Polysomnographic Technicians, and Polysomnographic Trainees working in hospital-based and freestanding sleep centers are exempted from the requirement of being licensed as Respiratory Care Practitioners. Due to the evolving standards of practice and credentialing in the area of Polysomnography, The Declaratory Ruling, in favor or the Petitioner, was held valid until January 31, 2011
