Second chaired a trial through verdict in the defense of an underinsured motorist claim involving an alleged traumatic brain injury (TBI) arising from a rear-end motor vehicle collision. Plaintiff supp ... orted her claim with advanced neuroimaging including Diffuse Tensor Imaging using high-resolution 3.0 Tesla MRIs. At trial, we argued that the advanced neuroimaging was still in its developmental phases that risked misattributing common physical brain abnormalities, such as those occurring from stress, smoking, depression or hypertension, to those indicative of a TBI. Plaintiff’s counsel asked the jury to award his client $3.2 million. The jury awarded the plaintiff only $58,000, which was reduced to zero after the set off for the underlying tortfeasor’s policy
