This was a record appeal of a Maryland district court's dismissal of my client's complaint for replevin on a contract for the return of certain goods.
OUTCOME: Reversal of Interlocutory Order
This was an appeal of an interlocutory order granting the Plaintiff an extension of her exclusive use and possession of the family home beyond the three year period allowed under Maryland law, as part ... of an order appointing a trustee for the sale of the family home. The Court of Special Appeals held that, because the buyer for whom the trustee was appointed ultimately refused to perform under the contract for sale, the issue of the trustee's appointment was moot. However, the Court agreed that the extension of the use and possession period for an indefinite period beyond the statutory maximum was reversible error.
OUTCOME: Judgment for Plaintiff
This was an action for unpaid rent against the defendant tenants. My client, the landlord, obtained a judgment on affidavit and we have since begun enforcement proceedings against the tenants.
