OUTCOME: Racketeering Case w/ All Charges Dismissed

Wiretap Racketeering Trial. Extensive Electronic Surveillance Evidence Issues. Client was charged as an accomplice in a large-scale prescription fraud case involving more then a dozen defendants. Exten ... sive Motion practice contesting the investigation and the seizure of phone calls and the seizure of evidence by search warrants were argued. Jury selection was completed after 14 days of selection. The audibility hearings were conducted lasting approximately 4 weeks, with all attorneys and their clients listening to the recorded conversations. Several defendants pled guilty and as a result the State moved to sever all charges against our client, with the charges against our client dismissed at the sentencing of the codefendants.

Client was charged in a 17 Count Indictment with numerous distribution and possession with intent to distribute drug-related crimes. If convicted after trial, client would have received at least 7 year ... s in prison with 3 imposed as a stipulated period of parole ineligibility. State offered 5 years with 20 months of parole ineligibility, and defense convinced prosecutor and court to sentence client to drug court (no custody, out-patient).

Client was charged with Aggravated Assault with a Knife, Possession of the Knife, and Possession of the Knife for an Unlawful Purpose. As originally charged, the crimes exposed the Client to 3-5 Years ... in State Prison. Based on legal issues and argument, the charges were downgraded to DP offenses (not crimes) and then dismissed by the Court, with an agreement that Client would attend 6 sessions of Anger Management Counseling.

Client was charged with Possession with Intent to Distribute CDS within 1000 feet of an Elementary School. On conviction of this charge, a defendant is sentenced to State Prison with a minimum of 3 yea ... rs without parole. Based on his prior record, client was eligible for sentencing to a mandatory extended term, which would have exposed him to 6 years of incarceration without parole. Based upon legal defects in the case, the defense successfully negotiated a plea to DP wandering, with fines only. (No incarceration, no probation).
