Client was charged in Lowell District Court with Possession with Intent to Distribute a Class D Controlled Substance (marijuana) in a School Zone (a charge which calls for a two-year mandatory minimum ... sentence in the House of Correction) after a police search of his motor vehicle, which was allegedly stopped within 1000 feet of a school, revealed a plastic baggie containing 15 smaller plastic baggies of marijuana. The search was conducted based solely on the police officer's detection of the odor of raw marijuana. Under the new law in Commonwealth v. Benjamin Cruz, co-counsel and myself moved to suppress all evidence discovered as a result of the motor vehicle stop and search. The motion to suppress was allowed.
