This was a 93A action. Plaintiff asserted a claim against Defendant for failure to refund money following the return of an American Eskimo Puppy. Defendant failed to respond to multiple attempts of g ... ood faith offers to setttle matter outside of court. Legal suit was brought by Linda Young on behalf of Plaintiff in the Lowell District Court. Plaintiff argued that there was sufficient documentation to prove that the Defendant had acknowledged the return of the puppy in writing and promised to mail a refund. Defendant failed to mail refund and Plaintiff argued that this was an unfair and deceptive act and considered unlawful under Section2 of MGL chapter 93A. Defefndant was found liable for treble money damages plus interest and fees and ordered to pay Plaintiff with 30 days of Judgment.
