On June 5, 2015 Massachusetts Superior Court Justice Robert A. Cornetta entered summary judgment on behalf of Altec, Inc., Altec Industries, Inc., ALTEC, LLC and ALTEC NUECO.
The case involved claim...s against numerous defendants stemming from serious and permanent personal injuries suffered by the plaintiff while he was utilizing a bucket truck to work on a high voltage power line. The bucket truck was designed and manufactured in 1998 by Lift-All, a division of Hydra-Tech, Inc. Hydra-Tech sold its assets to Altec, Inc. in 2008.
The four Altec entities were named as third party defendants in the case on the theory of successor liability. Judge Cornetta allowed the Altec defendants’ motion for summary judgment, finding that Altec, Inc. did not assume any of Hydra-Tech’s liabilities in the 2008 asset purchase.
