After Reliance Standard denied our client, a dentist, his disability insurance benefits, we brought suit in federal court. The evidence in favor of our client's disability due to chronic pain included ... a functional capacity evaluation, independent medical evaluation, peer review, declarations from colleagues, and medical records. The court found that the mountain of evidence supporting disability was more than enough to find he was totally disabled from working as a dentist.

After the insurance company (Liberty) terminated our client's benefits, the law firm filed an appeal, submitting substantial evidence of continued disability. The insurance company then denied the appe ... al and upheld their decision to terminate benefits. In completing its de novo review the Court stood in the shoes of Liberty and walked through our client's medical evidence. Ultimately, the Court determined that it would not have terminated the benefits under the circumstances and that Liberty’s decision to do so was wrong. Accordingly, the Court awarded our client past-due benefits, plus interest and reversed Liberty’s termination.
OUTCOME: We Won Back Our Clients Long Term Disability Benefits
Reliance Standard denied long term disability benefits to our client on the basis that her stroke was a preexisting condition because she was pregnant before her disability insurance policy was effecti ... ve and her pregnancy contributed to her suffering the stroke. We appealed the case to the Circuit Court of Appeals and won. The Court agreed with us that her preexisting pregnancy did not "substantially contribute" to the stroke, so the client's disability was not a preexisting condition. Ameritas denied our client's total disability claim on the basis that liver transplant surgery was not his only occupation. According to Ameritas, his pre-disability occupation included liver transplan ... t surgery, hepatobiliary surgery, and professor. Ameritas claimed he has three occupations in all—liver transplant surgeon, hepatobiliary surgeon, and professor—and that he was not totally disabled because he could continue working in two of the three. The court found that Dr. Millis’s pre-disability occupation was that of a liver transplant surgeon and that his other duties—hepatobiliary surgery and professorship—were part and parcel of the customary duties of a liver transplant surgeon. They were not separate occupations.
