Petitioner filed a request for a due process hearing under the IDEA and Section 504 of the Rehabilitation Act because School Board of Broward County refused to provide the minor child with an intractab ... le form of epilepsy and other disorders a second dose of Diastat should an in-school seizure not resolve after receiving the first dose. The child could not safely attend school without the assurance that she would receive the second dose if needed and thus missed hundreds of hours of instruction while this case was pending. The School Board hired two out-of-state experts to testify on their behalf and the child's neurologist testified on her behalf. Ms. Hertog successfully represented the child and her mother in a due process hearing in the FL Department of Administrative Hearings (DOAH).
