Represented utility company defending Sierra Club appeal of the utilitiy's PSD Permit to construct a coal fired power plant. After getting all but one count dismissed, settled case. The case was di ... smissed with prejudice and the plant was constructed in exchange for construction of additional wind power capacity and reduction of emissions at another plant.

OUTCOME: The Court vacated the rule as to utilities in Western Missouri and two other partial states who joined in our brief.

Represented a group of Western Missouri Utilities challenging EPA NOx SIP Call requiring power plants in 22 states and the District of Columbia to install billions of dollars of environmental controls. ... We argued that the data supported this regulation only for the Eastern portion of Missouri and should be vacated as to Western Missouri ("partial state" argument).
