We agree with the district court that Mote's association and speech rights to engage in the activities he alleged were clearly established. The police chief for the City of Athens Police Department placed James MacAvoy, a police officer, on indefinite suspension after an investigation revealed that MacAvoy had engaged in sexual relations w ... ith a woman while on duty and committed various other violations of department policy. MacAvoy appealed his termination. Pursuant to law, MacAvoy requested that the appeal be heard by an arbitrator. A two-day arbitration was held. The arbitrator ordered MacAvoy to be reinstated with back pay. The City appealed to District Court and then the 12th Court of Appeals. The City's first and second issues were sustained that the case was remanded to the trial court for trial.
